Terms and Conditions

1. Scope

These Terms and Conditions apply to the use of the Breeqo Taupunkt platform (web app at breeqo.io and the associated mobile app), operated by:

2. Service Description

Breeqo Taupunkt is a SaaS platform for automatic dew point ventilation control. The platform collects temperature and humidity data from connected sensors, calculates the dew point and controls connected ventilation actuators.

3. Registration and User Account

Registration with a valid email address is required to use the service. The user is responsible for keeping their login credentials confidential. Each person may only create one account.

4. Free and Paid Usage

4.1 Free Plan

The free plan includes limited features: 1 location, 1 room, 2 sensors, 1 actuator and 3 days of reading history. Online weather data is available for 14 days after registration.

4.2 Paid Plan (Pro)

The Pro plan costs €3.99 per month or €1.99 per month on the yearly plan (€23.88/year, incl. VAT) and offers extended features: up to 5 locations, unlimited rooms, sensors and actuators, 90 days reading history, permanent online weather data, email and push notifications, and manual override.

5. Subscription and Payment

The Pro subscription is billed monthly and automatically renews for one month unless cancelled before the end of the current period. Payment is processed via the payment service provider Stripe. For subscriptions through the Apple App Store, Apple's payment terms apply.

6. Cancellation

The free plan can be terminated at any time by deleting the user account. The Pro subscription can be cancelled at any time at the end of the current billing period. After cancellation, the account is downgraded to the free plan. For subscriptions through the Apple App Store, cancellation is done via the App Store subscription management.

7. Account Deletion

Users can delete their account at any time in the settings. Upon account deletion, all personal data, locations, rooms, sensors, readings and device settings are permanently deleted. An active Pro subscription must be cancelled before account deletion.

8. Availability

We strive for high platform availability but do not guarantee uninterrupted accessibility. Maintenance work and technical disruptions may lead to temporary limitations.

9. Limitation of Liability

Ventilation control is based on automatically collected sensor data. We assume no liability for damages caused by faulty sensor data, power outages, network interruptions or improper installation. Use of the automatic control is at the user's own risk.

10. Changes to Terms

We reserve the right to change these Terms at any time. Registered users will be informed of significant changes via email. Continued use after the changes take effect constitutes acceptance.

11. Applicable Law

The law of the Federal Republic of Germany applies. The place of jurisdiction is, insofar as legally permissible, Berlin.
